Compulsory School Age in New York

In most jurisdictions, children must start attending school or comply with homeschooling regulations by the academic year they reach 6 on or before December 1. They must continue their education until either the end of the school year, when they turn 16 or complete their high school education.

However, local boards of education have the authority to extend the mandatory attendance age in their school districts from 16 to 17 for unemployed minors.

Certain school districts have set a lower compulsory attendance age of 5 for children who reach this age on or before December 1, provided they enroll in public school. Parents can delay enrollment until their child reaches 6 by December 1.

How to Start Homeschooling in New York

Even if you’re outside of New York City, we can assist you in starting homeschooling in New York State, Connecticut, and New Jersey.  For elementary students (K-5), we can guide you through these steps to begin homeschooling:

New York State
  • Submit a Notice of Intent to Homeschool: Submit the notice to the district superintendent by July 1 (beginning of the school year) or within 14 days of establishing your homeschool program during the school year.
  • Create an Individualized Home Instruction Plan (IHIP): Submit the IHIP by August 15 or within four weeks of receiving the notice of intent. The IHIP includes your child’s name, age, grade level, syllabi, curriculum materials, and dates for submitting quarterly reports.
  • Maintain Attendance Records: Ensure your child attends school for the required number of hours: 900 hours per year for grades 1-6 and 990 hours per year for grades 7-12.
  • File Quarterly Reports: Submit quarterly reports to the school superintendent.
  • Comply with Subject Requirements: Teach the required subjects according to grade, including patriotism, citizenship, and substance abuse.
Students in homeschooling don’t receive credits, transcripts, or diplomas, and virtual schools aren’t recognized. However, online schools can fulfill homeschooling requirements. Committees on Special Education provide special education services and are reachable via email.
